原标题：上海金融法院成立了！将受理重大网络借贷、互联网股权众筹等新型民商事纠纷
新民晚报讯（记者 宋宁华）作为全国首个金融法院，上海金融法院正式挂牌成立。这是上海在全国率先展开司法改革“破冰之旅”后，又一次冲锋陷阵在司法改革的前沿阵地。今天上午，上海市高级人民法院召开新闻发布会，通报了上海金融法院成立的背景、意义及案件管辖、机构设置等情况。

发布会上，记者了解到，上海金融法院将对标国际最高标准，进一步提高金融审判专业化水平，提升金融审判质效和司法公信力，助力上海实现“到2020年基本建成与我国经济实力以及人民币国际地位相适应的国际金融中心”的战略目标。
和常见的按照行政区划设置的法院不同，金融法院属于跨行政区划的专门法院。上海金融法院院长赵红介绍，《最高人民法院关于上海金融法院案件管辖的规定》对此作了明确界定，其中包括上海市辖区内应由中级人民法院受理的证券、期货交易、信托、保险、金融借款合同等一审金融民商事案件，上海金融法院管辖上海市辖区内应由中级人民法院受理的以金融监管机构为被告的第一审涉金融行政案件等。

值得关注的是，网络借贷、互联网股权众筹等新型金融民商事纠纷首次纳入了金融法院的管辖范围。但赵红介绍，并非所有此类案件都将由金融法院一审，比如，对于网络借贷平台的民商事纠纷，诉讼标的额需高于5000万元人民币的才由金融法院一审。
据悉，目前金融法院共有入额法官28人，其中研究生以上26人，都是长期工作在金融审判一线的精英法官。
中国法院网讯 (严剑漪) 按照以习近平同志为核心的党中央深化司法体制改革、全面推进依法治国的重大决策部署，为健全完善金融审判体系、营造良好金融法治环境，上海金融法院8月20日正式揭牌成立。上海市委书记李强和全国人大常委会副委员长王东明为上海金融法院成立揭牌。
上海市委副书记、市长应勇宣读中共上海市委《关于设立上海金融法院的批复》，最高人民法院党组副书记、副院长江必新在揭牌活动上讲话。上海市委常委、市委秘书长诸葛宇杰，市人大常委会副主任沙海林，市政协副主席徐逸波，市人民检察院检察长张本才出席，市高级人民法院院长刘晓云主持。
揭牌后，李强、王东明、应勇、江必新等察看了上海金融法院诉讼服务中心。李强等同现场工作人员一一握手，询问人员配备情况，了解窗口服务范围。随后走进审判法庭，这里除具备同步录音录像等信息化技术外，还具有远程庭审、互联网直播、证人远程出庭、跨境远程认证等功能。李强在听取上海金融法院建设相关情况后说，中央在上海设立金融法院，是对上海的信任和重托，要充分发挥好人民法院的职能作用，依法妥善审理金融案件，有效规范金融秩序，切实维护金融安全，依法服务和保障金融改革。要深入推进正规化、专业化、职业化建设，打造一支既政治过硬又本领高强的一流金融审判队伍，为上海国际金融中心建设提供有力法治保障。
2018年3月28日，中央全面深化改革委员会第一次会议审议通过了《关于设立上海金融法院的方案》；4月27日，十三届全国人大常委会第二次会议通过了《关于设立上海金融法院的决定》；7月31日，最高人民法院审判委员会通过《关于上海金融法院案件管辖的规定》。上海金融法院正式成立后，将紧紧围绕金融工作服务实体经济、防控金融风险、深化金融改革的任务，对金融案件进行集中管辖，推进金融审判体制机制改革，着力提高金融审判质效和司法公信力，提升国际金融交易规则话语权；借鉴发达国家和新兴市场国家金融司法的有益经验，结合我国经济社会发展状况以及审判工作实际，探索完善中国特色的金融司法体系；深化司法体制改革，优化司法职权配置，全面落实司法责任制，规范审判权力运行机制，实行法官员额制，精干内设机构，推行扁平化管理。
